The objective of the project is to promote private sector investment in renewable energy sources in Kazakhstan to achieve the country’s 2030 and 2050 renewable energy targets. The project targets both large-scale and small-scale renewable energy sources.

The goal of this project is to achieve transformation of the energy market in Kazakhstan by significantly increasing the scale of the use of renewable energy sources in electricity production, thereby increasing the share of renewable energy in the country's power generation mix from 1.1% in 2017 to 10% by 2030. 
 
To achieve its objective, the project includes activities to support renewable energy projects that are expected to bring about a collective GHG emission reduction of at least 460,000 tonnes of CO2. In addition, by the end of the project, the project would have supported the commissioning of 9.5 MW of direct, small-scale renewable energy system (RES) that will produce about 500 GWh of electrical energy.
 
The project includes three components:
 
Component 1 – Large-Scale Renewable Energy: Policy and Financial Derisking Measures
Component 2 – Renewable Energy for Life: Policy Derisking
Component 3 – Renewable Energy for Life: Financial Derisking and Incentives
 
This task is carried out in accordance with Component 2 of the Project: Activity 2.1.1 “Design and implement appropriate policies, programmes, and regulations. The approach used will follow the UNDP DREI framework, as adjusted for small-scale renewables – this will inform the selection and design of appropriate policy derisking tools. In addition, the fiscal and financial effects of small-scale on-grid RE will be studied", Task 2.1"Appropriate policies, programmes and regulations for on- and off-grid small-scale renewables designed and implemented."
 
Supporting the Ministry of Energy of the Republic of Kazakhstan on activities related to the introduction of amendments and additions to the Law on the Support of Renewable Energy Sources and related regulatory legal acts (hereinafter - RLA) on stimulating the development of small-scale renewable energy projects in accordance with regulatory procedures. 
 

Duties and Responsibilities

Responsibility:
 
The expert will be responsible to perform a set of functions outlined below in a timely and quality manner. This will include a contribution to the implementation of the work plans, preparing reports,  interact with other team members in the project and the country office, as well as engage with external counterparts. The expert will also perform other duties as required within the scope of work of this assignment.
 
Functions:
  • Provision of assistance to the Ministry of Energy of the Republic of Kazakhstan and the DREI Project in terms of promoting previously developed changes and amendments to legislation, pertaining to stimulating the development of small-scale RES projects, in the Parliament / in associations of RES and/or the electric power industry and other interested institutions. The assistance includes: 
  1. Active participation in meetings / discussions; 
  2. Active participation in working groups; 
  3. Development and provision of justifications for the adoption of previously developed amendments to legislative acts regulating relations between the stakeholders (private energy companies, infrastructure operators, supervisory and regulating authorities, and other involved stakeholders) in the field of renewable energy;
  • Development of new amendments, if necessary (to be determined by the Ministry of Energy of the Republic of Kazakhstan) and/or adjustment of previously developed changes in legislative acts regulating relations in the field of renewable energy, including, but not limited to, the Law on the Support of Renewable Energy, the Law on Electricity, Entrepreneurial and Tax Codes, Rules for the provision of subsidies, monitoring of small-scale renewable energy devices, the State standards and regulations for the issuance of subsidies;
  • Formulation of proposed amendments/additions to changes and/or development of new changes, in accordance with item 2 above, that must be presented in the form of a comparative table in MS WORD format, indicating the current version / proposed edits and obligatory justification of the proposed changes and additions;
  • Formulation of proposed changes and additions to the RLA (newly developed RLA) that must be presented to the Department of RES of the Ministry of Energy of the Republic of Kazakhstan;
  • Preparation, presentation, and submission of an analytical report based on the results of the work performed under this consultancy assignment.
Institutional Arrangement
 
The contractor bears full responsibility for the accuracy and legality of the information provided and for the timely provision of reports. The expert works under the direct supervision of the Project Manager and in close collaboration with the project team.

Required Skills and Experience

Min. Academic Education:
  • Bachelor’s degree in law or other related field;
  • Master's degree in law or related field is an advantage; 
Min. years of relevant Work experience:
  • At least 7 years of relevant experience on legal issues in the field of energy sector both at national and international levels including 5 years of work experience as a lawyer in large energy, energy service, engineering companies or government bodies regulating the energy sector or international programmes focused on the energy sector on developing legal acts, etc. 
  • Minimum 5 years of practical experience in implementing the renewable energy projects; 
  • Experience with UN/UNDP is an advantage.
Required Language(s) (at working level):
  • Fluency in Russian and/or Kazakh;
  • Knowledge of English is an advantage
