ORGANIZATIONAL SETTING & THE POSITION

Strengthening the capacity of prosecutors, judges and lawyers in Rwanda in international criminal law is both important and timely. Over twenty-five years after the 1994 genocide that occurred in Rwanda, the number of cases transferred from the UN-ICTR and UN-MICT and extradited from other countries to Rwanda continues to increase.  

Rwanda’s Transfer Law incorporates many common law procedural rules foreign to Rwanda’s standard practice. Transfer cases have been adjudicated in Rwanda since 2012, but the application of changes to the Transfer Law continues to affect the work of prosecutors, judges and lawyers in Rwanda, as they all adapt to a new legal procedure which is unfamiliar in many significant aspects.  

Given that international criminal law is a complex and evolving field, prosecutors who appear in Transfer cases would benefit from skills allowing them to more accurately and effectively research and apply the latest judicial precedents. Similarly, a further opportunity to hone their research, drafting, and courtroom advocacy skills would permit Rwandan defense lawyers representing accused in Transfer cases to provide more effective legal representation to their clients. Finally, the availability of both a judicial Transfer case practice manual and templates of judgements, decisions and orders would enable Judges tasked with hearing these cases to adjudicate them uniformly and by issuing judicial decisions presenting standard structure and language.  

The purpose of the consultancy is to assist with the facilitation of the training sessions including guiding some discussions including through interpretation if necessary, translation of support documents and materials in preparation for the trainings, the practice guides on international criminal law (ICL) and the judicial templates. The consultant will also be the point person on the ground for all logistical arrangements with the clients and various vendors.

IDLO seeks a part-time Local Facilitator/Translator Consultant with a strong interest and passion for the Organization’s mission.  Under the direct supervision of the Lead and Senior Consultants, the Local Facilitator and Translator Consultant will be responsible for the following activities:  

  • Assist the Lead and Senior Consultants by translating into Kinyarwanda (and French if needed) training materials including power point presentations, a judicial practice guide, and judicial templates as needed; 
  • Assist in conducting a desk study to review relevant filings before Rwandan courts (NPPA and RBA) and case law, particularly of the International Chamber of the High Court, Court of Appeals and Supreme Court and translate them into French and/or English as needed;  
  • Facilitate the training program and assist with interpretation into Kinyarwanda and/or French/English as needed; 
  • Assist the Lead and Senior Consultants with logistical and administrative matters regarding the organization of the training between sessions and providing logistical support to the training participants and Lead and Senior Consultant;  
  • Perform any other related tasks required by the Lead and Senior Consultants.  

Specific Deliverables:  

  • In coordination with the Lead and Senior Consultant, provide assistance in the facilitation, translation and logistics of a 9-week capacity-building and technical assistance program focusing on:  

NPPA Training 

  • Session 1 Substantive and Procedural International Criminal Law (2 weeks); 
  • Session 2 International Criminal Legal Research and Practice (2 weeks); 
  • Session 3 Fundamental Procedural Rights in ICL Proceedings (2 weeks); 
  • Moot Trial Advocacy session (1 week); 
  • Training of Trainers session (1 week); 

RBA Training 

  • Refresher Training session for the RBA practitioners (1 week) 

Judiciary Technical Assistance 

  • Drafting of judicial templates of decisions and judgments and a practice manual for the Judiciary including a one-day delivery and implementation session.

Timing:  

Session 1 will take place during the weeks of 16 and 23 March 2020, with full-time availability required from Sunday 15 March 2020 through Friday 27 March 2020.  

 The timing of the other sessions and deliverables will be between April 2020 and June 2021 and will be determined depending on the availability of the NPPA, RBA, and Judiciary so a large degree of flexibility is required. 

Dates will always be determined as early as possible.

EXPERIENCE REQUIRED

  • Education and Experience: Law degree required. Bar admission desired. International criminal law experience required. Litigation experience desired. 
  • Languages: Fluency in French, English and Kinyarwanda required.
  • Scheduling flexibility required.
  • The Facilitator should be based in Kigali, Rwanda.

TERMS AND CONDITIONS

For performing all tasks and services and producing the Deliverables, IDLO shall compensate the Contractor the amount of Nine Thousand Euros (€ 9,000).

Payments to the Contractor shall be disbursed as follows: 

Payment 1st instalment 

1,500 EUR 

After Session 1 (NPPA Training) 

Payment 2nd instalment 

1,500 EUR 

After Session 2 (NPPA Training)

After Session 3 (NPPA Training)

After the Moot Trial Advocacy Session (NPPA Training)

After the delivery of the templates and practice manual and 1-day workshop (Judiciary) and the RBA refresher training (RBA)

After facilitation of the Training of Trainers (NPPA Training)
