Individual Consultant - Support to the Mining Sector in Zimbabwe

Background

UNDP has been working with the Government of Zimbabwe through the Ministry of Mines and Mining Development collaborating with EMA, ZELA and PACT to implement a 10 month long  “Preparatory support to the Sustainability of the Extractives sector in Zimbabwe project”. The objective of the project is to support the creation of a sustainable and responsible mining sector through two strategic interventions namely legislative, policy and technical advisory and support as well as support to the artisanal and small-scale mining sector. 

The initiation plan provides a framework for responding to immediate needs of the sector whilst piloting, drawing lessons, and identifying priorities on which to frame a fully-fledged programme in the sector. Hence, the project will have the following results and outputs:

Result 1: Legislative, Policy and Administrative Support: UNDP proposes to initiate initial steps towards a robust mining governance framework by supporting short-term policy reforms that ensures that this sector begins to take steps towards a responsible sector, in line with the African Mining Vision and African Mining Governance Framework, the SADC Mining Protocol, the Extractive Industries Transparency Initiative (EITI), and other relevant Multilateral Environmental Agreements to ensure that shortfalls are addressed and that sector reforms are sustainable. The project will support the review of the legislative and policy gaps including those related to the draft Mines and Minerals Amendment Bill and specific minerals policies. In addition, given the pressure towards regularization, the project will support the development of a consulted national ASM strategy. Furthermore, the project will support and strengthen the constitutional mandate of Parliament. Initial support for digitisation of the current mining claims database with the aim of setting the basis for longer term support of creating a modernized digital cadastre system. Through our global networks UNDP will bring in positive experiences from other countries at all levels of investment in this sector. 

The two main outputs that will be delivered under this result area are:

  • Output 1: Legislative and policy gaps analysis report and draft amendments to the MMAB and specific minerals policies; 
  • Output 2: National ASM strategy that incorporates a safety, health and environment framework, ASM desks and a digitised mining titles database. 

Result 2: Support to Safe Artisanal and Small-scale Mining (ASM) Investments: The importance of ASM, and the gold sector to Zimbabwe, motivates UNDP’s intended support for initiatives that seek to promote regulation, decriminalization and safe operations in ASM. To respond to the immediate needs of the ASM sector, this project will support the development of safety, health and environmental related risks guidelines and the awareness there of.  In addition to the policy interventions regarding the national ASM strategy, this project will support the setting up an ASM desk, the development of ASM investment guidelines and the initial activities for piloting of clean ASM practices with strong collaboration with the Environmental Management Agency, with a particular focus on women and youth in small scale mining communities. The latter will be achieved through research, showcasing and awareness around health and environmentally safe technologies, gender equality, conflict prevention and basic human rights sensitivity. The initiation plan will start the current piloting efforts of completely mercury free model site, by funding research to develop a prototype that can be used in a Zimbabwean context. Through collaboration with other players and NGOs, the project will set the pace for the expected gradual reduction and final elimination in mercury use over time. In addition to smart technologies, providing organization, institutional and security of tenure support to ASM communities will result in more responsible ASM operations. The intervention will also support the development and roll out IT based applications to enhance risk awareness and knowledge among small-mining communities.  

The main output that will be delivered under this result area is:

  • Output 3: Low footprint ASM practices sufficiently researched and demonstrated across 2 mining communities.

Result 3: A multi-stakeholder consulted project proposal: In the long-term, transforming mining enterprises into low environment and health footprint, and socially conscious operations requires technology modernization including to reduce or avoid use of dangerous chemicals. During this phase, the project will facilitate debate around these issues and explore opportunities for long-term support to transform the sector. Under the initiation plan, UNDP will use the activities under the other three outputs to further guide the development of a long-term programmatic intervention in the sector. Activities therefore include researching through the conduction of field visits, desk research and consultations. Stakeholder consultations will be undertaken to establish long-term needs and identify priority actions and relevant partners. By the end of the year, a fully-fledged project document will have been developed.

The main output that will be delivered under this result area is:

  • Output 4: A multi-stakeholder consulted project proposal document and secure partnership commitments in place. 

The Project, which ends in December 2019 is expected to inform the design of a longer-term project idea which will be designed to address medium and long term needs of the sector. 

There is commitment to the project under a broader collaboration platform with other partners for a more comprehensive sector support programme. Whilst the programme is envisaged to focus on the ASM sector, it is also expected to provide support to broader mining governance and administrative issues confronting the sector. The project will also consider replicating and scaling up lessons and prototypes from this Initiation plan phase with some national level interventions and with strong links to the mining cadastre work by the Ministry. 

It is with this background that UNDP Zimbabwe Country Office seeks to engage a mining sector expert/consultant to support the formulation of Project document in consultation with the Ministry of Mines, UNDP, EMA, ZELA PACT and other stakeholders.  The consultant is being sought to develop a full Proposal in line with the guidelines and format of the UNDP proposal document.  

The consultant will need to have expertise in Project document development, extensive experience in mining sector especially ASM, institutional capacity assessments, policy and legislative analysis and a good understanding of the mining governance and administrative systems incorporating rights based, gender and youth dimensions. S/he should demonstrate ability to analyse context and challenges and formulating development solutions through a clear theory of change and logical results and resources framework to deliver the desired change.   

The scope of work is further elaborated below.

Duties and Responsibilities

Under the guidance of the Head of the Poverty Reduction and the Head of Governance Units in the UNDP Zimbabwe Country Office, and in consultation with the broader UNDP team, the consultant will be expected to develop a Full Proposal. He/she will be expected to deliver the Full Proposal with the timelines agreed with UNDP to allow for review before the deadline for submission.

Mining issue in Zimbabwe are complex with interest and expectations from different stakeholders including Government, Donors, Constitutional bodies, Civil Societies, Private Sector and Beneficiaries. The process of formulating the project should therefore be highly inclusive, participatory, with buy in and support from Government and should address needs of different stakeholders. Furthermore, proposal should clearly indicate how it will contribute to coordinated support from the various development partners and other actors in this sector.  

The Project Development Consultant shall be expected to:  

  • Reviewing of Project documents related to work undertaken between in 2018;
  • Reviewing government documents related to mining administration and governance;
  • Identifying baselines in terms of policies, legislation and stakeholders that are relevant to the proposed Project;
  • Conducting field visits to at least 3 ASM sites and Mining Provincial Offices in Matabeleland, Midlands, Mashonaland and Manicaland, organising and facilitating technical and consultative meetings/workshops with the Ministry, other government organisations, development partners, private sector, ASM sector representative, miners associations/organisations/unions, and non-governmental organisations in the sector;
  • Identify institutional capacities and strategic capacity building areas of the related Ministry and other entities and any identified partners to be involved in the Project implementation, and identifying to be included in the Project document;
  • Recommend an appropriate project implementation mechanism and a coordination arrangement between UNDP-and its partner with donors; 
  • Undertaking information management desk assessment with particular emphasis on mining claims management information systems and and include activities for strengthening capacity in this area decision making on mining governance and administration;
  • Drafting the Proposal in line with guidelines;
  • Drafting relevant annexes to meet the needs of UNDP. 

The Full Proposal should meet the following Criteria

  • Relevance of the project to needs and constraints of the sector in Zimbabwe, the region;
  • Appropriateness of target group and targeting approach;
  • Effectiveness of proposed activities;
  • Feasibility of the proposed strategy and action plan;
  • Quality of results monitoring indicators;
  • Stakeholder engagement including potential implementing partners and beneficiaries;
  • Demonstrated innovation and best practice application;
  • Capacity/capability of the UNDP manage the proposed project;
  • Demonstrated sustainability;
  • Appropriateness of resources allocation for cost effectiveness;
  • Demonstrated value for money.

The consultant will be expected to present the drafts to UNDP and its partners and incorporate recommendations as may be required. 

Expected deliberables

The three (3) key deliverables under this consultancy are: 

  • Inception Report with detailed methodology and stakeholder engagement plan; 
  • Draft Full Proposal with Annexes and Stakeholder Engagement Report;
  • Final Draft of Full Proposal with Annexes.

Institutional arrangements for management of the consultancy

The principal responsibility for managing this assignment lies with the UNDP Country Office, Zimbabwe. UNDP will contract the consultant and ensure the timely provision of reimbursable costs and remuneration. UNDP will mobilise internal technical expertise to support the consultant’s work. UNDP will support the consultant’s engagement with stakeholders, arrange for meetings, field visits and coordinate with Zimbabwe Government.

Under the overall supervision of the UNDP the consultant will be in charge of the quality of the consultations with stakeholders, collection and analysis of data and generation of baselines and the LogFrame to inform the development implementation and monitoring of the Project. 

Timeframe

The consultancy is expected to run between 25 November 2019 and 31st December 2019 during which the consultant is expected to provide 30 days of services. 

The indicative time guideline for the Consultancy is as follows:

Proposal Stages 

  • Contract Signed with Consultant 25 November 2019;
  • Detailed Methodology and Approach to work submitted and signed off with UNDP Consultant 29 November 2019;
  • Stakeholder Consultation 30 November 2019;
  • Delivery of first draft of the Project Proposal for Review 5 December 2019;
  • Stakeholder Validation of the Proposal 10 December2019;
  • Delivery of Revised Draft incorporating comments from Stakeholders 16 December 2019; 
  • Donor Meeting presentation 18 December 2019.

Required Skills and Experience

Education:  

  • Master’s degree or equivalent in Mining sector, Project development and management or related field.

Experience:

  • At least ten years’ experience in analytical and practical work in  the following: (a) mining, ASM,  (b) institutional capacity assessment and policy analysis and (c) mining administration and information management systems;
  • Extensive experience in designing, developing and implementing developmental projects (Problem Analysis, Theory of Change Logframe Design/Results and Resources Framework);
  • Ability to assess complex situations succinctly distilling critical issues, and provide forward-looking conclusions and recommendations;
  • Ability to work with a diversity of people and deliver quality reports/work;
  • Excellent negotiations skills, research and presentation and communications skills;
  • The purpose of the consultant is to provide a specialised technical support to the UNDP Country Office Zimbabwe and its partners to design a Proposal document for a Mining Sector that addresses the development support needs of the sector and meets both the UNDP, GOZ and its partners’ expectations.  It will also further strengthen the already established cooperation between the UNDP, its collaborating partners and the Min. of Mines through a well thought out Project document for implementation.

Evaluation criteria:

The Consultant will be evaluated based on qualifications and the years of experience, as outlined in the qualifications/requirements section of the ToR.  In addition, the Consultant will also be evaluated on the following methodology:

Technical Criteria weight: 70%;

Financial Criteria weight: 30%;
